TERMS AND CONDITIONS OF SALE

The following conditions are accepted by both the Buyer and Seller.

INTERPRETATION

§ “The seller” or “The Company” means He-Shi Enterprises Ltd T/A 4Beauty Group.

§ “The Buyer” means the person, firm or the company buying Products from the Company.

§ “Products” means items forming the subject matter of the contract between the buyer and the seller.

§ “Orders” means the Buyer’s instructions to the Company to supply the Products.

 

CONTRACT

§ The contract shall be made only upon the Company’s acceptance of the Buyer’s order for the Products which are the subject of the contract (“the Products”). The date of the contract shall be the date specified on the invoice issued to the Buyer (“the invoice date”).

§ The Products are not sold on a sale or return basis.

§ The Products are sold on the understanding that they will be used for their intended purpose, for the Buyer’s own use, or used in treatments performed by the Buyer or their staff or retailed from the Buyer’s place of business. No responsibility will be accepted by 4 Beauty Group, for trained or untrained personnel without qualified supervision using or misusing equipment or Products supplied by us. At no time may the buyer retail Products via a website or online marketplace, specifically not Amazon, TikTok, eBay, Gumtree or sub distribute the Products at discounted prices without written permission from the Company or a contractual agreement being in place.

§ The Company reserves the right to withhold products if the Buyer is in breach of these conditions or is conducting their business in any way which is detrimental to any of the Company’s brands.

 

PRICES

§ All prices are correct at the time of printing but are subject to alteration without prior notice.

§ All prices will be exclusive of VAT at ruling rates and delivery charges.

PAYMENT

§ Payment is due in full prior to dispatch of goods unless a credit agreement is agreed beforehand.

§ If a credit agreement exists then payment is due in full, within the agreed period from the invoice date. Further orders will not be dispatched whilst a balance is outstanding.

§ We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month.

 

DELIVERY CHARGES

Charges if applicable will be invoiced with the order and will vary dependant upon order size.

 

GUARANTEE

All items are guaranteed according to the manufacturer’s warranty. All glass items are specifically excluded from this guarantee.

 

CANCELLATION

Cancellation after despatch of goods cannot be accepted.

 

CLAIMS

§ When delivery of Products is the responsibility of the Company, the risk in such property is passed to the Buyer on delivery.

§ When delivery of Products is the responsibility of the Buyer, the risk in such property is passed to the Buyer on collection.

§ Claims for loss or damage of goods in transit or shortage cannot be accepted unless the Company is advised within 48 hours of receipt of goods. The Company must be informed in writing within 14 days of receipt in the case of a loss. The Company will not entertain claims made outside the stated time limits.

 

RETURNED GOODS

When goods have been ordered in error, the Company may agree to their return on the following conditions.

§ A request has been made to the Company within 48 hours of receipt of the goods.

§ Any approved Products for return must be in its original condition, unworn or unused and sent back to us in its original packaging. Your statutory rights are not affected.

§ All returns will be subject to a 10% restocking charge.

For your own protection, please obtain a receipt from the carrier as the Company accepts no responsibility for lost parcels.

 

GENERAL

All offers in our catalogue are subject to stock availability and we reserve the right to restrict or refuse any order or application for credit at any time. We take special care to show correct sizes and specifications whilst given as a guide, in good faith, are subject to alteration by the Seller without notice.

 

RETENTION OF TITLE CLAUSE

§ The risk in all goods passes to the Buyer upon delivery but the title in the goods remains vested in 4 Beauty Group and shall only pass from the Company to the Buyer upon full payment being made on (sums due on all monies on whatsoever accounting grounds) to 4 Beauty Group.

§ The Buyer agrees that prior to the payment of the whole price of the goods, 4Beauty Group or appointed agents may enter the Buyer’s premises to collect such goods should the Seller request. Prior to such payment, the Buyer shall keep the goods separate and identifiable for this purpose, and return the goods to the Seller should the Seller request.
